Project Overview:
TROJENA (The Mountains of NEOM) will be an iconic, world-class destination, blending natural and developed landscapes and will offer unique experiences for residents and visitors alike. Located in the northwest of Saudi Arabia in the region of Tabuk just 50km from the coast, TROJENA will be a destination like no other on earth. Based upon the principles of eco-tourism facilities will include a folded vertical village, a lake with water sports and event facilities, high altitude ski village, observatory, world leading health and wellbeing facilities and a nature reserve which will be home to unique wildlife, heritage sites and exploration opportunities.
With over 3,600 hotel, 2,200 homes, 9 iconic buildings and 100 world class indoor and outdoor experiences Trojena will become the ultimate mountain destination. Bechtel will provide a full range of project management services to assist the delivery of this iconic destination.
Job Summary:
In support of the Programme Director and Commercial Director, performs and or leads a multidisciplinary team of claims professionals conducting all activities associated with construction claims and dispute resolution. Significant proactive engagement required with the project management team, other departments, customers, and stakeholders to enable successful alignment on construction claims and associated disputes, processes, procedures, and the critical activities for project success. Also, performs other duties as assigned.
We are seeking candidates with broad experience in infrastructure project management consultancy claims experience with specific experience resorts, buildings, earthworks, and other civil works.
The ideal candidate is extremely adept at leading team(s) in managing the claims functions for major programs from inception through completion. Major scope elements include development and maintaining of the contracting strategy, contract formation and administration and claims, as a senior member of the Commercial Team. Activities will include delivery of critical items required from initial project set-up, through to defining and developing a team, to establishing coordinated procedures and controls, and to management of team(s) with accountability for work product to project milestones, quality, and safety standards. Maintains significant proactive engagement with program management, customer, and internal and external stakeholders to enable successful alignment on systems, processes, procedures, and critical program activities.

Major Responsibilities:
- Engages with senior management team and customer to develop and align strategy, methods, and controls for the safe and successful performance of the works.
- Conducts team management, guidance, and development to effectively execute the works including staffing, budgeting, training and retention, and contract formation, administration, and claims.
Job Duties:
General:
Operates as a senior manager and leader of a multi-discipline claims department for the Trojena programme. Selected candidate will be the first person in the department, responsible for establishing the team, processes, and procedures in line with the customer’s requirements. Additionally, the candidate will support the formation and administration teams with day-to-day tasks; the contracts, agreements and orders under this purview are NEOM executed, and PMC administered.
Contract Administration
- Reviews, implements, authors, and or suggests revisions to the NEOM and program administration procedures and processes.
- Reviews and suggests revisions to the contract terms and conditions to identify and monitor areas of risk, ambiguities, conflicts, or deviations from the requirements.
- Develops, reviews, implements and or manages appropriate mechanisms to monitor compliance with contract terms and conditions.
- Conducts identification, administration, management, and resolution of Contract claims as the develop, including engagement of Bechtel Corporate Legal, as necessary.
Claims Administration
- Reviews, implements, authors, and or suggests revisions to the NEOM and PMC claims procedures and processes and NEOM terms and conditions (forms of contracts).
- Claim analyses and evaluation, strategy and position preparation, ability to articulate the contractors’ position against the contracts terms and conditions and recommend a position for NEOM.
- Implementation and managing of commercial policies and procedures across the program including establishment of the counterclaim correspondence tracking and retention processes.
- Identification and management of commercial risk to NEOM.
- Overseeing, managing, directing, and supporting the project commercial teams to ensure optimization of project returns.
- Perform evaluation of both contractual and legal entitlement.
- Identify, collect, and evaluate relevant facts and records.
- Collate related information and provide analysis based on facts, records, and contract requirements.
- Prepare, perform, brief, and advise strategies for claim resolution, defenses, and counterclaims.
- Prepare reports, presentations and recommendations related to administration, claims, and disputes.
- Lead, perform and interface with delay analyses processes for all planning and time elements of claims.
- Advise and perform appropriate methods of delay and program analyses including evaluation of quantum.
- Provide substantiation and advice related to claims.
- Produce well-written, concise reports and letters, with minimal revisions required.
- Manage the input of the commercial view into the customer’s decision-making process around triggering disputes and or litigation.
- Undertake assessments of contractor’s applications, certifications, variations, and claims.
- Provide independent conclusions and recommendations, manage claims and disputes, ensuring that factual and robust contractual and commercial input is considered.
- Work closely with the Commercial Director, Area Senior Contracts Managers, Senior Contracts and Contracts Managers, Contracts Administrators, and the Customer’s Commercial Team to identify and ensure exposure is correctly diagnosed, accurately reported, and where appropriate, effectively mitigated.
Education and Experience Requirements:
- Degree in Business, Quantity Surveying, Law or Engineering or other related degree.
- Experience and completion of courses in pricing, contract law, contract drafting, contract administration and negotiation of change orders, effective correspondence, planning and scheduling.
- Demonstrated leadership and teamwork capabilities suitable for managing a workforce of many nationalities and backgrounds.
- Direct experience interviewing / personnel selection, salary planning, performance evaluations, career counseling and resource allocation.
- Extensive skill in working and communicating effectively, both orally and in writing, with other project functional groups, Customers and Stakeholders.
- Thorough knowledge of contract language, claim processes and legal requirements of construction contracts across a variety of contract types. Ability to review major complex bespoke contracts in the building and civil engineering sectors to identify and communicate risks and mitigation strategies.

Preferred Attributes:
- Minimum 25+ years’ experience in construction focused commercial management of infrastructure projects of the mega-project size, especially looking for an individual that has major buildings and or resorts experience in claims.
- Claims experience of 15+ years.
- Team leadership of 10+ years.
- Experience in Middle East and especially Saudi Arabia.
- Arabic Language.
